ORIGIN TO INDONESIA'S EXPORTED GOODS

Decision of the Director General of Foreign Trade No. 32/DAGLU/KP/X/2004 on Technical Provisions on Certificate of Origin of Indonesia's Exported Goods.

To stipulate :

THE REGULATION OF THE DIRECTOR GENERAL OF FOREIGN TRADE ON TECHNICAL PROVISIONS ON THE ISSUANCE OF CERTIFICATE OF ORIGIN TO INDONESIA'S EXPORTED GOODS.

Article 1

(1) Every institution issuing Certificate of Origin (SKA) shall convey names of officials authorized and responsible to sign SKA as well as alternate officials, specimens of signatures and specimen of special seal of SKA to the Directorate of Export and Import Facilitation, Ministry of Trade by using the form as contained in Attachment I to this regulation.

(2) In the case of any change in the officials authorized and responsible to sign SKA and alternate officials, as meant in paragraph (1), the institution issuing SKA shall convey all names of the old and new signing officials, specimens of signatures and specimen of special seal of SKA to the Directorate of Export and Import Facilitation, Ministry of Trade.

(3) The Directorate of Export and Import Facilitation, Ministry of Trade shall forward the names, specimens of signatures and specimen of special seal of SKA to Representatives of the Republic of Indonesia abroad to be conveyed to the authorized government institutions in their accreditation countries.

(4) The officials authorized and responsible to sign SKA and alternate officials officially can sign SKA after receiving letter of appointment from the Director General of Foreign Trade, Ministry of Trade.

Article 2

(1) Based on Regulation of the Minister of Trade No. 17/M-DAG/PER/9/2005, the Director General of Foreign Trade shall be authorized to stipulate institutions issuing SKA and officials authorized and responsible to sign SKA or alternate officials.

(2) Trading Affairs Service in provincial/regental/municipal governments, which can be stipulated as an institution issuing SKA shall meet the following requirements:

(3) Reduction or addition to institutions issuing SKA, officials signing SKA or alternate officials shall be stipulated by the Director General of Foreign Trade.

Article 3

(1) The institutions issuing SKA and officials signing SKA or alternate officials stipulated on the basis of Regulation of the Minister of Trade No. 17/M-DAG/PER/9/2005 shall be as contained in Attachment II to this regulation.

(2) The institutions issuing SKA and officials signing SKA or alternate officials stipulated by the Director General of Foreign Trade outside the names mentioned in Attachment II to this regulation shall be declared null and void as from January 1, 2006.

Article 4

The institutions issuing special SKA to certain exported goods as meant in Attachment VIII to this regulation shall be declared to come into force as from November 1, 2005:

Article 5

Institutions issuing SKA shall convey report on the receipt and use of form SKA as contained in Attachment III as well as report on the realization of export on the basis of SKA as contained in Attachment IV to this regulation every month to the Secretary of the Directorate General of Foreign Trade.

Article 6

(1) Institutions issuing SKA shall mention reference no in every kind of form SKA by putting abbreviation to names of the respective regions of institutions issuing SKA.

(2) The abbreviation to names of regions as meant in paragraph (1) shall be contained in Attachment V to this regulation.

Article 7

Technical directives regarding institutions issuing SKA, procedures and mechanism of the issuance of SKA and verification of SKA shall be stipulated by the Director General of Foreign Trade, as contained in Attachment VI to this regulation.

Article 8

(1) Null and spoiled forms of Certificate of Origin (SKA) shall be destroyed.

(2) In order to realize the destruction of forms of SKA as meant in paragraph (1), a team for destruction of Forms of SKA shall be established by institutions issuing SKA.

(3) In connection with the destruction of forms of SKA, account of destruction of certificates of origin shall be made and reported to the Directorate General of Foreign Trade in this case the Secretary of the Directorate General of Foreign Trade, Ministry of Trade by mentioning kinds of forms, serial numbers and quantity of forms of the destroyed SKA.

Article 9

The regulation shall come into force 3 (three) months as from the date of stipulation.
